  1. What This Privacy Policy Covers
    1. This privacy policy covers the use of the web site located at https://www.charliestable.com and the services provided by Charlie’s Table, Inc. ("CT"), including how CT treats personal information that CT collects and receives.
    2. Pursuant to CT Terms of Use, you must be eighteen (18) years and older to use this site or have permission from a legal guardian. Therefore, this policy makes no provision for individuals under eighteen (18) years old.
    3. This policy does not apply to the practices of third parties that CT does not own or control, or individuals that CT does not employ or manage.

  2. Information Collection:
    1. CT collects personal information when you register to use CT services or to post content on CT’s web site. At registration you are asked for your email address and possibly other optional information.
    2. CT automatically receives and records information on our server logs from your browser, including your IP address, cookies, and the pages you request.

  3. Information Disclosure: CT will not sell or disclose your name or email address to third parties without your explicit consent, except as specified in this Privacy Policy.

  4. Use of information for the following general purposes:
    1. Information you provide from time-to-time may be used for products and services provisioning, billing, identification and authentication, services improvement, contact, research, and anonymous reporting.
    2. IP addresses are automatically reported by your browser each time you view a web page. Your IP address is stored in CT's user registration databases when you register with CT. IP addresses may be used for various research purposes, and/or delivering unique functionality.

  5. Service Announcements
    1. CT will send you a welcome email when you sign up to make a purchase or for other CT's services. CT will send you service announcements on occasions when it is necessary to do so.
    2. You may not opt-out of service-related communications, which are not promotional in nature. If you do not wish to receive them, you have the option of asking us to deactivate your account by emailing webmaster@charliestable.com from the email address you signed up with.

  6. Administrative Messages.
    CT may periodically email you with administrative messages. If you don't wish to receive administrative messages, simply opt-out by emailing support@charliestable.com. Please note that if you do not wish to receive administrative messages from us, those notices will still govern your use of the CT website and service. You are responsible for reviewing such notices for changes.

  7. Third Party Use Of Your Personal Information
    1. CT will not sell or rent your personal information to third parties for their marketing purposes without your explicit consent.
    2. Your information may be combined with information CT collects from other people and/or companies and used to improve and personalize services, content and advertising.
    3. CT may share aggregated demographic information with business partners.

  8. Password
    1. Keep your password secure. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality.
    2. You agree to immediately notify CT of any unauthorized use of your password or any breach of security.
    3. You also agree that CT cannot and will not be liable for any loss or damage arising from your failure to keep your password secure.

  9. Your Account
    1. Information: You must keep your account information up-to-date and accurate at all times, including a valid email address.
    2. Transfer: You may not transfer or sell your CT account and User ID to another party.
    3. Business entity: If you are registering as a business entity, you personally guarantee that you have the authority to bind the entity to this Agreement.

  10. Newsletter Emails
    1. CT users are offered subscriptions to CT’s email newsletter. To opt-in, CT will ask for your email address. This email address will only be used for this feature.
    2. You may change your subscription or unsubscribe at any time by following the instructions contained in the email.

  11. Friend Features
    1. "Share with a Friend" allows members to share information about a specific item listed on CT by sending a personalized email message.
    2. If you choose to use CT’s “Share with a Friend" feature, CT will ask for the information needed to send the message, such as your friend's email address. CT will then automatically send your friend an email, inviting your friend to visit the site.
    3. CT does not store "Share with a Friend" information on our servers.

  12. Cookies
    1. A cookie is a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a web site's computers and stored on your computer's hard drive.
    2. You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set.
    3. If you reject all cookies, you may not be able to take full advantage of the CT service.
    4. CT uses its own cookies for a number of purposes, including to:
      1. Access your information when you "sign in"
      2. Keep track of preferences you specify while you are using CT's services or looking at CT’s offerings
      3. Display local product offerings
      4. Estimate and report CT's total audience size and traffic
      5. Conduct research to improve CT's content and services.
    5. CT cookies do not collect personal information.
    6. CT does not combine information collected through cookies with other personal information to tell us who you are or what your username or email address is.

  13. When You Post A Message.
    Your CT ID or alias is visible to other users. If you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return.

  14. Personally Identifiable Information
    a. 
    CT will not rent, sell, or share personal information about you with nonaffiliated parties except as specified in this Privacy Policy, to provide products or services you have requested, or when CT has your permission. b. CT may be required to disclose personally identifiable information under special circumstances, for example: i. To parties in compliance with CT's Copyright and Intellectual Property Policy. ii. As CT, in its sole discretion, believes necessary or appropriate in order to investigate, prevent, or take action regarding illegal activities, piracy, intellectual property infringement, suspected fraud, situations involving potential threats to the physical safety of any person, violations of CT’s Terms of Use, as specified in this Privacy Policy or other unlawful activity or as otherwise required by law. iii. In such events, CT may disclose name, street address, city, state, zip code, country, phone number, email address and company name. c. CT may provide services or sell products jointly with affiliated businesses. Due to the nature of CT's business model, when an affiliated business is associated with your transaction, we will share customer information that is related to such transaction with that affiliated business. d. CT employs other companies and people to perform tasks on our behalf and needs to share your information with them to provide products and services to you. Examples include but are not limited to fulfilling orders, handling billing disputes, analyzing data, providing marketing assistance and providing customer service. e. In some cases, CT may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that is transferred. CT will transfer information about you if CT is acquired by or merged with another company. In this event, CT will notify you by email or by putting a prominent notice on the CT web site before information about you is transferred and becomes subject to a different privacy policy. f. As part of the buying and selling process, you may obtain another CT user's email address, shipping address and/or other information. Pursuant to CT’s Table's Terms of Use, you have a limited license to use this information. This information should only be used for CT-related communications or for CT-facilitated transactions. CT has not granted you a license to use the information for unsolicited commercial messages. Without limiting the foregoing, without express consent from the user, you are not licensed to add any CT user to your email or physical mail list.

  15. Third Parties
    1. Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information CT collects from you. If you disclose your information to others, whether they are buyers on CT or throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them.
    2. CT does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.
    3. CT is not responsible for the privacy or security practices of other websites on the Internet, even those linked to or from the CT site. CT encourages you to ask questions before you disclose your personal information to others.

  16. Personal Information We Collect (And Why)
    a. 
    User Data: i. This is the personal data that is provided by you or collected by us to enable you to sign up for and use CT services. This may include your username, email address, phone number, birth date, street address, and country. ii. Some of the personal data we will ask you to provide is required in order to create your account. You may also have the option to provide us with additional personal data in order to make your account more personalized. b. Usage Data: This is the personal data that is collected about you when you are accessing and/or using the CT service, including information about your interactions with the CT service such as your search queries (including the date and time of any requests you make), purchase history, and your product browsing history. It can also be inferences drawn about your interests and preferences based on your usage of the CT service.
    c. Certain technical data, which may include: i. URL information. ii. Online identifiers including cookie data and IP addresses. iii. Information about the types of devices you are using such as network connection type (e.g. wi fi, 3G, LTE), provider, network and device performance, browser type, language, and operating system. iv. Your non-precise location which may be derived or inferred from certain technical data (e.g., your IP address, language setting of your device, or payment currency). v. Such date may be used to monitor for unusual/suspicious account activity, as well as to deliver personalized content and advertising to you.
    d. Payment and Purchase Data We may collect certain personal data if you make a purchase through the CT service. The exact personal data collected will vary depending on the payment method (e.g. credit card or PayPal) but will include information such as: i. Name. ii. Date of birth. iii. Credit or debit card type, expiration date, and certain digits of your card number. iv. Postal code. v. Mobile phone number. vi. Details of your purchase and payment history.

  17. Third Party Sources 
    a. Authentication partners: If you register for or log into our services using third party credentials (e.g. Facebook), we will import your information from such third party to help create your account with us.b. Technical service partners: We work with technical service partners that provide us with certain data, such as mapping IP addresses to non-precise location data (e.g., city, state), to enable us to provide the CT service, content, and features.c. Payment partners: If you choose to pay for a service or feature by invoice, we may receive data from our payment partners to enable us to send you invoices, process your payment and provide you with what you have purchased.d. Advertisers and other advertising partners: We may obtain certain data about you, such as cookie id, mobile device id, or email address, and inferences about your interests and preferences from certain advertisers and advertising partners that allow us to deliver more relevant ads and measure their effectiveness.

  18. What We Use Personal Information For
    1. To provide and personalize CT service.
    2. To understand, diagnose, troubleshoot, and fix issues for any and all services provided by CT.
    3. To evaluate and develop new features, technologies, and improvements to CT services.
    4. To comply with legal obligations and law enforcement requests.
    5. To conduct business planning, reporting, and forecasting.
    6. To process your payment.
    7. To detect fraud, including fraudulent payments and fraudulent use of any CT services.

  19. Requesting, Editing, And Deleting Account And Personal Information
    1. You can change your CT Account Information (except your username), at any time. CT may send you certain communications relating to the CT service, such as service announcements and administrative messages that are considered part of your CT account. You can delete your CT account by emailing support@charliestable.com. Please note that your identification, billing and contact information may remain in CT's records for some period.
    2. CT limits access to personal information about you to employees who CT believes reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs. Your CT Account Information is password-protected.
    3. If your personally identifiable information changes you may correct or update it by making the change on your CT account page. You may delete or deactivate your account by emailing Customer Support at webmaster@charliestable.com. CT will respond to your request within 10-20 business days.

  20. Security.
    The security of your personal information is important to us. Your CT account information is protected by a password for your privacy and security.
    1. You need to work to protect against unauthorized access to your password and to your computer by signing off once you have finished using a shared computer.
    2. CT follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once CT receives it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while CT strives to use commercially acceptable means to protect your personal information, CT cannot guarantee its absolute security.
    3. When you enter sensitive information (such as credit card number) for registration, CT encrypts that information.

  21. Prohibitions. You must not misuse this Website.
    a. 
    By accessing out website, you agree not to: i. Commit or encourage a criminal offense. ii. Transmit or distribute a virus, trojan, worm, logic bomb or any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene. iii. Hack into any aspect of the Service. iv. Corrupt data. v. Cause annoyance to other users. vi. Infringe up on the rights of any other person’s proprietary rights. vii. Send any unsolicited advertising or promotional material, commonly referred to as “spam”. viii. Attempt to affect the performance or functionality of any computer facilities of or accessed through this Website.b. Breach of any of these prohibitions would constitute a criminal offense and CT will report any such breach to the relevant law enforcement authorities and disclose your identity to them. c. CT will not be liable for any loss or damage caused by any of the above prohibitions. d. Likewise, CT will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

    1. CT reserves the right to modify this Privacy Policy at any time, so please review it frequently.
    2. If CT makes material changes to this Privacy Policy you will be notified here, by email, or other places CT deems appropriate.
    3. If this Privacy Policy is changed, CT will post changes on this website.
